Terms of Service

1. Acceptance of terms

By downloading, installing, or using Vivid Walls ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. License

Vivid Walls grants you a limited, non-exclusive, non-transferable license to use the App on any Apple device you own or control, subject to the Apple Media Services Terms and Conditions.

3. Wallpaper Engine content

Vivid Walls is a renderer for Wallpaper Engine scene files. To use wallpaper content, you must own a valid license of Wallpaper Engine on Steam. You are responsible for ensuring you have the right to use any wallpaper content you import into Vivid Walls.

Vivid Walls is not affiliated with, endorsed by, or connected to Wallpaper Engine, Kristjan Skutta, Valve Corporation, or Steam. "Wallpaper Engine" and "Steam" are trademarks of their respective owners.

4. User content

You are solely responsible for the wallpaper content you import and use with Vivid Walls. The App does not host, distribute, or provide wallpaper content. All content is transferred directly from your own devices.

5. Acceptable use

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Use the App to distribute content you do not have rights to
• Remove or alter any proprietary notices or labels on the App
• Use the App for any unlawful purpose

6. Disclaimer of warranties

Vivid Walls is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will render all Wallpaper Engine scenes perfectly. Compatibility varies by wallpaper complexity, and some wallpapers using advanced features like SceneScript may have limited support.

7. Limitation of liability

To the maximum extent permitted by applicable law, Vivid Walls and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

8. Refunds

Refunds are handled exclusively through the Apple App Store in accordance with Apple's refund policy. To request a refund, visit reportaproblem.apple.com.

9. Updates and changes

We may update the App from time to time. Updates may modify or remove features. We reserve the right to modify these Terms of Service at any time. Continued use of the App after changes constitutes acceptance of the new terms.

10. Termination

These terms are effective until terminated. Your rights under these terms will terminate automatically if you fail to comply with any term. Upon termination, you must cease all use of the App and delete all copies.

11. Governing law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
